TERMS AND CONDITIONS OF SALE (TCS)

Preamble
These terms and conditions of sale (hereinafter “TCS”) govern the contractual relationships between helpme-online.com (hereinafter “the Administrator” or “the Site”), the vendors (hereinafter “the Suppliers”) offering their services on the site helpme-online.com, and the users/customers (hereinafter “the Clients”). The Site acts as an intermediary and collects a commission on each sale made.

Any use of the Site and any order placed imply the unconditional acceptance of these TCS.

1. Purpose
These TCS define the rights and obligations of the parties regarding the sale of services offered by independent Suppliers via the Site. The Administrator facilitates the transaction and manages the platform but is not responsible for the content of the services provided.

2. Services offered
The Site allows Suppliers to offer their services online. Each Supplier is responsible for the content of the services they offer, including descriptions, prices, and specific conditions. The Client is responsible for reviewing the service descriptions before placing an order.

3. Order and Acceptance
The Client places an order directly with the Suppliers via the Site. Once the order is placed, the Supplier is responsible for executing the service. The Administrator acts solely as an intermediary and assumes no responsibility for the quality or conformity of the services provided.

4. Commission and Pricing
The Administrator collects a commission on each sale made via the platform, calculated based on the sale price of the service. The service prices are displayed in US dollars (USD) and include applicable taxes. Suppliers set their prices independently.

5. Payment Methods
Service payments are made via the secure payment platform provided by the Administrator. The Client makes the payment online, and the Administrator redistributes the amount due to the Supplier, after deducting the commission.

6. Service Delivery
Services are delivered by the Suppliers according to the terms agreed with the Client at the time of the order. The Administrator is not responsible for delays or failures in service delivery, which are the sole responsibility of the Suppliers.

7. Right of Withdrawal
The Client has a 10-day withdrawal period from the time of purchase, except if the service begins with the Client’s consent before the end of this period. In the event of a withdrawal, costs may be borne by the Client, according to each Supplier’s policy.

8. Supplier’s Responsibility
Suppliers are solely responsible for the proper execution of the services sold on the Site. The Administrator disclaims all responsibility in case of non-compliance, delay, or any other issue related to the service execution.

9. Administrator’s Responsibility
The Administrator acts as a platform for connecting Suppliers and Clients. It is not responsible for the content or quality of the services offered by Suppliers. In the event of a dispute between the Supplier and the Client, the Administrator may intervene as a mediator but is not obligated to resolve the dispute.

10. Data Protection
The personal data collected during the use of the Site is processed in accordance with the Act Respecting the Protection of Personal Information in the Private Sector. The Client and Suppliers agree that the Administrator may use their data for the purpose of managing transactions and business relations.

11. Intellectual Property
All elements of the Site, including texts, graphics, logos, and images, are the exclusive property of the Administrator or its partners. Any reproduction, distribution, or use without prior authorization is strictly prohibited.

12. Modification of the TCS
The Administrator reserves the right to modify these TCS at any time. The changes will take effect upon publication on the Site. The TCS applicable at the time of the order will remain in effect for that order.

13. Applicable Law and Jurisdiction
These TCS are governed by the laws in force in Quebec and Canada. In the event of a dispute, the parties agree to seek an amicable solution before bringing the matter to the competent courts in Quebec.

14. Claims and Mediation
In the event of a dispute related to the execution of a service, the Client may submit a claim to the Supplier. If no agreement is reached, the Administrator may be requested for mediation, without guaranteeing the resolution of the dispute.
